Anti-discrimination
The General Equal Treatment Act prohibits discrimination on the grounds of sex. The Netherlands Institute for Human Rights has clarified in several opinions that this also includes discrimination on the grounds of gender identity and sex change. Since 2019, this has been explicitly included in the law.
Transition in the workplace
Employers have a statutory duty of care for a safe working environment. Practical considerations during a transition at work include forms of address, toilet use, personnel data and dress codes.
Dismissal and discrimination
Dismissal or detrimental treatment on the grounds of a transition can be unlawful. Complaints can be submitted to the Netherlands Institute for Human Rights or through civil proceedings.
