Since the introduction of marriage for same-sex couples (2001), a marriage in the Netherlands remains intact when one of the spouses makes a change in sex registration.

Since the introduction of marriage for same-sex couples (2001), a marriage in the Netherlands remains intact when one of the spouses makes a change in sex registration. Unlike in countries without same-sex marriage, a marriage in the Netherlands does not need to be dissolved before or after transition.

International recognition

Outside the Netherlands, legal recognition may be different. In countries that do not recognise marriage for same-sex couples, a changed sex registration may affect the recognition of the marriage.

Practical consequences

Practically, the marriage does not change due to a transition. However, it may be necessary to have documents amended (passport, BSN, municipal registration) and to inform the partner with institutions.
