Registration at birth
In the Netherlands, for descent law, the sex as registered in the birth certificate is decisive. With a changed sex registration, older descent ties remain in place: a trans man who was registered as mother for previously born children retains that status.
Children born after transition
For children born after the transition, registration depends on the current sex registration of the parents. Legislation is developing on this point; in 2023 the Supreme Court ruled in a specific case that a trans man can be registered as 'father' although he gave birth to the child.
International
Outside the Netherlands, policy differs widely. Some countries register a transgender parent according to the current gender registration; others follow the birth sex. With international law and migration this can lead to complications.
